These Terms of Use (the “Terms”) govern your access to and use of CanCater’s website, mobile applications, and related services (the “Platform”). By using our Platform, you agree to these Terms and to comply with applicable Canadian laws. If you do not agree, you must stop using the Platform.
1. Who We Are
CanCater provides a technology marketplace that connects customers with restaurants and caterers (“Food Providers”) for catering orders and delivery.
- We are not a restaurant, caterer, or delivery company.
- Food Providers and delivery partners are independent businesses.
- CanCater is not responsible for food quality, preparation, packaging, or delivery.
2. Eligibility
You must be at least 18 years old to use the Platform. If you use it on behalf of an organization, you confirm you have authority to bind that organization.
3. Accounts
To place or manage orders, you may need to create an account with accurate information. You are responsible for keeping your password secure and for all activity under your account. If you suspect unauthorized access, contact us at support@cancater.ca.
4. Payments & Cancellations
- Payments are processed through third-party providers on behalf of Food Providers.
- Charges may apply if you cancel an order, fail to show up for pickup, or are unavailable for delivery.
- Refunds, if any, are determined by the Food Provider’s policies.
5. User Content
You may post reviews, ratings, or other content (“User Content”). By doing so, you grant CanCater a licence to use, display, and share your content in connection with the Platform. You are responsible for ensuring your User Content is truthful, lawful, and does not infringe third-party rights.
6. Prohibited Conduct
You agree not to:
- Use the Platform for illegal purposes
- Post harmful, offensive, or misleading content
- Misuse the Platform through scraping, hacking, or spamming
- Infringe intellectual property rights
7. Intellectual Property
All content on the Platform (except User Content) belongs to CanCater or its licensors. You are granted a limited, non-transferable license to use the Platform for personal or authorized business use only.
8. Liability & Disclaimers
The Platform is provided “as is”. CanCater makes no guarantees about the quality of food, timeliness of delivery, or accuracy of restaurant information. To the fullest extent permitted by Canadian law, CanCater’s liability is limited to the total amount paid by you for the order giving rise to the claim.
9. Termination
We may suspend or terminate your access to the Platform at any time if you violate these Terms or misuse the service.
10. Governing Law
These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein. Any disputes must be resolved in the courts located in Toronto, Ontario.
11. Changes
We may update these Terms from time to time. If we make material changes, we will notify you through the Platform or by email. Your continued use means you accept the revised Terms.
